Terms and Conditions for SMS Communications

1. Acceptance of Terms
By providing your mobile telephone number and consenting to receive SMS messages from DUVADIE Law Professional Corporation (“DUVADIE Law”, “we”, “us”, or “our”) through our web forms, client intake, client portal, or by replying to our opt-in message, you agree to these Terms and Conditions for SMS Communications (the “SMS Terms”). If you do not agree, do not enrol in or use the SMS program.
2. Scope of SMS Program
We may send transactional and service-related SMS messages, including appointment reminders, scheduling communications, billing notices, service updates, and other messages related to your relationship with DUVADIE Law and your matters with us. Message frequency may vary.
3. Personal Information Collected
3.1 Identifiers: Name, mobile telephone number, preferred language, and client/matter identifiers.
3.2 Communication Data: Message content sent by SMS, opt-in/opt-out status, timestamps, and message logs.
3.3 Technical and Usage Data: Device type, carrier, and delivery status information.
3.4 Relationship and Account Data: Your relationship to the firm, scheduling preferences, and service preferences.
4. How Personal Information Is Collected
4.1 Directly from You: When you provide your mobile telephone number and consent via our web forms, client intake, client portal, or by replying to opt-in messages.
4.2 Through SMS Interactions: From your interactions with our SMS messages, including replies, STOP/HELP requests, and delivery confirmations.
5. How Personal Information Is Used
We use the personal information described in Section 3 for the following purposes:
5.1 Program Delivery: To provide, operate, and administer the SMS program, including appointment reminders, scheduling, billing notices, and service updates.
5.2 Identity and Consent Management: To authenticate identity for SMS-related requests, manage opt-ins and opt-outs, and maintain records of consent.
5.3 Service Improvement: To improve message relevance, frequency management, and service quality.
5.4 Legal and Professional Obligations: To comply with legal and regulatory requirements, professional obligations, and to exercise or defend legal claims.
6. Non‑Sharing Policy
Personal information collected through SMS communications, including SMS consent and phone numbers, is used solely by DUVADIE Law to administer the SMS program and is not shared, disclosed, or transferred to any third parties or affiliates for their own use. We do not sell or rent personal information collected through the SMS program.
7. Your Choices and How to Opt Out
You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you may receive a one-time confirmation message. To resume messages, reply START to a prior message or re-enrol through our web forms, client intake, or client portal. 8. Fees and Availability
Message and data rates may apply from your carrier. You are responsible for any such charges. SMS delivery may be subject to transmission or coverage limitations. We are not responsible for delays or failures in delivery because of carrier or network issues.
9. Accuracy and Security
You are responsible for ensuring the accuracy of the mobile number you provide. We implement administrative, technical, and physical safeguards designed to protect personal information collected through the SMS program. No system is completely secure, and we cannot guarantee absolute security.
10. Data Retention
We retain personal information collected through the SMS program only for as long as necessary to fulfil the purposes described in these SMS Terms or as required by legal, regulatory, or professional obligations, after which it will be securely deleted or de-identified, subject to our legal hold and record keeping requirements.
11. Eligibility and Authority
By enrolling, you represent that you are the owner or customary user of the mobile number provided and that you have the authority to provide consent to receive SMS messages at that number.
12. Changes to These SMS Terms
We may update these SMS Terms from time to time. Material changes will apply prospectively. The “Date” at the top indicates the most recent update. Continued participation in the SMS program after changes become effective constitutes acceptance of the revised SMS Terms.

14. Interpretation and Governing Law
These SMS Terms are intended to be read together with our engagement terms and privacy practices applicable to our legal services. To the extent of any conflict concerning SMS communications, these SMS Terms govern. These SMS Terms are governed by the laws of Ontario, and the federal laws of Canada applicable therein, and disputes shall be addressed in the courts of Ottawa, Ontario, subject to any mandatory professional conduct requirements.
